This site is operated by Fifth Avenue Photographic, LLC, a U.S. limited liability company. Throughout these terms, "we," "us," and "our" refer to that company. "You" and "your" refer to anyone accessing or using The Grid Index.
2. What this site is
This site is the marketing and documentation hub for our WordPress products — the editorial theme, the RSS Importer plugin, and any related tooling we publish. It also displays sample headlines aggregated from third-party publishers via RSS as a demonstration of what the theme and plugin do.
We are a software company, not a news publisher. We do not generate, edit, or take editorial responsibility for the third-party headlines surfaced on this site. Every aggregated headline links back to the publisher that produced it.
3. Our software (GPL)
All WordPress themes and plugins we publish — including The Grid Index theme and the RSS Importer plugin — are licensed under the GNU General Public License, version 2 or any later version (GPL-2.0-or-later). You may use, copy, modify, and redistribute them under the terms of that license.
The GPL does not extend to our brand name, logo, screenshots, or marketing copy on this site — those remain our trademarks and copyrighted material. You may reference our products honestly (e.g., to write a review, tutorial, or comparison) without further permission.
4. Third-party headlines and feeds
Headlines, summaries, and any other content displayed on this site that originates from a third-party publisher (via RSS or otherwise) remain the property of the originating publisher. Each item links to the publisher's own website where their full article and their own terms of use apply.
Use of aggregated headlines on this site is intended as fair use / fair dealing for demonstration, indexing, and navigation purposes. If you are a publisher and would like a feed removed, contact us and we will act promptly.
5. Acceptable use
You agree not to use this site to:
- Probe, scan, or test the vulnerability of the system, or breach security or authentication measures.
- Interfere with or disrupt the service or the servers and networks connected to it (e.g., flooding the contact form, automated scraping at abusive rates).
- Use any robot, spider, scraper, or other automated means to access the site beyond standard search-engine crawling.
- Submit content that is unlawful, threatening, defamatory, infringing, or designed to harass any person.
- Reverse-engineer, decompile, or otherwise attempt to extract source code from compiled portions of the service (none of our published software is closed-source, so this clause mostly covers attempts to bypass site security).
6. Administrator accounts
If you have been granted a WordPress account on this site (administrator, editor, or any other role), you are responsible for keeping your credentials secure and for any activity that occurs under your account. Notify us immediately if you suspect your account has been compromised.
7. Contact submissions
When you submit a message through the contact form, you confirm that the information you provide is your own (or that you have permission to send it on someone else's behalf), and that the content does not violate any law or anyone else's rights.
We treat submissions as confidential to the extent practical, but we make no guarantee against accidental disclosure. Do not submit sensitive information (passwords, payment details, government IDs, medical records) through the contact form.
8. No warranty
This site and our software are provided "as is" and "as available," without warranty of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, secure, or free of viruses or harmful components. To the maximum extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Fifth Avenue Photographic, LLC or its members, employees, or contributors be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business interruption — arising from your use of this site or our software, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential damages; in those places, our liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Fifth Avenue Photographic, LLC from any claim or demand — including reasonable attorneys' fees — made by a third party arising out of your use of this site, your violation of these terms, or your infringement of any law or any right of a third party.
11. Changes to these terms
We may update these terms from time to time. When we do, we update the "Last updated" date at the top. Material changes will be announced on the site for at least 14 days before they take effect. Continued use of the site after the effective date constitutes acceptance.
12. Governing law
These terms are governed by the laws of the United States, without regard to its conflict-of-laws principles. Any dispute arising from these terms or from your use of the site will be brought exclusively in the federal or state courts located in that jurisdiction, and you consent to personal jurisdiction there.
13. Miscellaneous
These terms, together with our Privacy Policy, are the entire agreement between you and us regarding this site. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any right is not a waiver of that right.
